Terms of Use

GymSweat is a fitness and workout tracking application available on Android, iOS, and the web. It allows you to log workouts, track health metrics, follow training programs, and optionally connect with a coach through the GymSweat Coach platform.

By creating an account, you agree to these Terms of Use. If you do not agree, do not use GymSweat.

1.1 Eligibility

You must be at least 18 years of age to use GymSweat. If you are between 16 and 18, you may use GymSweat only with verifiable parental or guardian consent. GymSweat is not intended for children under 16.

Use of the app and any physical activity undertaken in relation to it is at your sole risk. GymSweat does not provide medical advice. Always consult a physician before starting any workout program.

You acknowledge that physical exercise carries inherent risks of injury. GymSweat is a tracking tool and does not supervise, instruct, or monitor your physical safety. You are solely responsible for determining whether any exercise is appropriate for your fitness level and health condition.

All data, metrics, scores, analytics, and suggestions displayed in GymSweat — including but not limited to estimated one-rep max (e1RM), load scores, acute-to-chronic workload ratio (ACWR), recovery scores, coaching insights, strength classifications, and injury logs — are provided for informational and tracking purposes only.

They do not constitute medical advice, diagnosis, or treatment. You should not rely on GymSweat output to make health decisions. Always seek the advice of a qualified healthcare professional for any medical condition or concern.

The GymSweat Coach platform enables fitness coaches to view athlete data and provide general fitness guidance. The following terms apply:

• Coaches using the platform provide general fitness guidance only — not medical advice, physiotherapy, or any form of healthcare.
• Athletes control which data categories are shared with their coach via granular permissions and may revoke access at any time.
• GymSweat does not employ, certify, or endorse any coach. Coaches are independent professionals solely responsible for the guidance they provide.
• GymSweat is not liable for any advice, instruction, or recommendation given by a coach through the platform.

GymSweat offers a free tier and a premium subscription ("GymSweat Pro"). Subscriptions are managed through the following payment providers depending on the platform:

• iOS: Apple App Store (via RevenueCat)
• Android: Google Play Store (via RevenueCat)
• Web (Coach Dashboard): Paddle.com Market Ltd (Merchant of Record)

Billing and renewals: subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.

Refunds:

• For mobile subscriptions: refund requests are handled by Apple or Google according to their respective refund policies.
• For web subscriptions: refund requests are handled by Paddle according to their refund policy. You may also contact us directly.

Free trial: if a free trial is offered, you will not be charged until the trial period ends. Cancel before the trial ends to avoid being charged.

To the maximum extent permitted by applicable law, GymSweat's total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the service shall not exceed the total amount of fees you have paid to GymSweat in the 12 months preceding the event giving rise to the claim.

GymSweat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury arising from your use of the app or reliance on its content.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, nor for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer protection provisions under Italian law (Codice del Consumo, D.Lgs. 206/2005).

These Terms are governed by and construed in accordance with the laws of Italy.

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Trieste, Italy, unless:

• You qualify as a consumer under the Italian Consumer Code (D.Lgs. 206/2005), in which case the mandatory consumer forum (foro del consumatore) — i.e., the court of the place of your residence or domicile — shall apply. This right cannot be waived.
• Mandatory EU regulations (e.g., Regulation (EU) No 524/2013 on online dispute resolution) provide alternative dispute resolution mechanisms.

For EU consumers, the European Commission's Online Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr.

All intellectual property rights in the GymSweat app, website, brand, logo, and content (excluding user-generated content) belong to Filippo Machnich or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use GymSweat for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of all workout data, templates, and personal content you create within GymSweat.

You may delete your account at any time via Settings → Account → Delete account. We may suspend or terminate your account if you violate these Terms, with reasonable notice where possible.

Upon account deletion, your data will be erased in accordance with our Privacy Policy.
